HES 9400 SWEEPSTAKES Official Rules
NO PURCHASE OR SMS TEXT MESSAGE (“Text Message”) REQUIRED TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Each Text Message, sent or received, may incur a charge as provided in your rate plan. If you enter via text-messaging, you may incur charges for at least two (2) Text Messages.
1. PROMOTION: The HES 9400 Sweepstakes (“Sweepstakes”) is sponsored by HES/Hanchett Entry Systems, Inc., 22630 N. 17th Avenue, Phoenix, AZ, 85027 (“Sponsor”). The Sweepstakes starts at 12:00:01 AM Mountain Standard Time (“MST”) on March 1, 2010 and ends at 11:59:59 PM MST on June 30, 2010 (“Promotion Period”). All applicable federal, state and local rules apply. Void where prohibited or restricted by law.
2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia at least eighteen (18) years of age at the time of entry. Employees, directors, officers, agents, and contractors of HES/Hanchett Entry Systems, Inc., (“Sponsor”) and BoomText (“Administrator”) (collectively known as “Sweepstakes Entities”) and each of their parent companies, subsidiaries, affiliates, advertising and promotion agencies involved with this Sweepstakes, as well as the members of the immediate families and persons living in their households of such employees are not eligible to enter. The Sweepstakes shall be staged in compliance with all applicable federal, state, and local laws and are void to the extent they are not in compliance. Participation constitutes entrants’ full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. By entering, entrants release Sweepstakes Entities and their respective parent companies, subsidiaries, affiliates, directors, officers, contractors, employees and agents from any responsibility and all liability whatsoever for any injuries, losses, death or damages of any kind caused by participation in the Sweepstakes or in connection with acceptance, possession, use, or misuse of Prize provided pursuant to the Sweepstakes.
3. HOW TO ENTER:
a. Enter by Text Message: If you have a two-way text messaging capable device, you may enter the Sweepstakes by texting "HES9400” (4379400) to the shortcode “411247”. You will then be entered into the Sweepstakes, you will receive a return Text Message acknowledging your entry, and your cell phone number will be entered into the database maintained by Administrator for the purposes of this Sweepstakes. Entrants that enter by text messaging will be charged according to their wireless carrier’s standard text messaging rates for each Text Message sent or received as provided in their rate plan (contact your carrier for pricing plans and details). Check your owner’s manual for specific text messaging instructions. Text messaging may not be available through all wireless carriers. By submitting an entry via Text Message, entrants are giving their express consent and authorization to receive future Text Messages related to the Sweepstakes for which you will be charged standard text messaging charges. You may opt out of receiving Sweepstakes Text Messages at any time by texting "STOP" (7867) to shortcode “411247”.
For every entry submitted and confirmed via Text Message, you will receive one (1) entry into the Prize drawing. This Sweepstakes is limited to one entry per phone number. Opting out will remove you from receiving future Text Messages and alerts, but will not affect your chances of winning the Sweepstakes drawing. Please use caution and do not disrupt traffic or drive in an unsafe manner while participating in the entry process.
PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES BY TEXT MESSAGING, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE SWEEPSTAKES OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSOR IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
b. Enter by Mail: To enter without sending a Text Message, hand print your name, address, day and evening phone numbers, email address (if any), age, and “HES 9400 Sweepstakes” on a 3” x 5” piece of paper and mail it with the proper postage to HES 9400 Sweepstakes, 22630 N. 17th Avenue, Phoenix, AZ, 85027. You will receive one (1) Sweepstakes entry. Only one (1) entry per envelope will be accepted. All mail-in entries must be postmarked by June 30, 2010, and received by July 18, 2010. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification.
In the event of a dispute as to the identity of an entrant entering via the methods set forth above in Section 3, the authorized account holder of the device used to enter, if applicable, will be deemed to be the entrant. "Authorized account holder" of a device is the natural person in whose name the device has been issued and to whom services are billed.
4. CHANGE OF DEVICE NUMBER POLICY: It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his/her device number. To do so, write to: HES 9400 Sweepstakes, 22630 N. 17th Avenue, Phoenix, AZ, 85027.
5. PRIZE DRAWINGS: Ninety-four (94) Grand Prize winners will be selected by Sponsor in a random drawing on or about July 19, 2010, from all eligible entries received and/or postmarked by June 30, 2010. Odds of winning depend on the total number of eligible entries received.
6. PRIZES: The Grand Prize consists of one (1) HES 9400 Series electric strike (“Prize”). Approximate Retail Value of Prize: $450.00 U.S. Sponsor reserves the right to substitute Prize with prizes of equal or greater value, if Prize becomes unavailable for any reason. All merchandise will be selected at the sole discretion of Sponsor. The depiction of Prize in any advertising or promotional materials may not reflect the actual Prize delivered to the winners.
Winners are solely responsible for any and all taxes on Prize, as well as any and all expenses relative to participation in the Sweepstakes not specified herein, and any taxes or fees associated with Prize receipt and/or use. No prize substitution allowed except at sole discretion of the Sponsor. Prize is not transferable. Prizes will be awarded. Any portion of Prizes not accepted by winner will be forfeited.
Sponsor shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to by any cause, condition, or event whatsoever beyond the control of Sponsor.
7. SELECTION OF WINNERS AND RELEASE: Potential winners will be notified within approximately ten (10) days after drawing by Text Message, telephone, email, or mail and may be required to sign and return an Affidavit of Eligibility/Release of Liability and Publicity Release (“affidavit”) where legal. If a potential winner does not reply to such notification, the notification is undeliverable and/or the Affidavit is not returned as instructed within seven (7) days of transmission, potential winner will be disqualified and an alternate winner will be selected in a random drawing. Once the Affidavit is received and verified by Sponsor, confirmed winners will be notified by telephone to make delivery arrangement. In the event of a dispute regarding who submitted a Text Message entry, the entry will be deemed submitted by the authorized accountholder of the device account. Sponsor reserves the right to disqualify any person that Sponsor determines to be in violation of any term contained in these Rules. By accepting Prize, except where prohibited, all winners grant to Sponsor and their advertising and promotional agencies the right to use, and publish his or her proper name, likeness, voice, opinions, biographical information and state and announce winner's name, home city and state in any media to promote Sponsor and the promotion without additional compensation. By accepting a Prize, winners also release Sponsor, their directors, officers, agents, employees, officers and consultants and their marketing and promotion agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the Prize.
8. CONDITIONS OF PARTICIPATION: Sponsor is not responsible for misdirected mail, incorrect or inaccurate capture of entry information, including but not limited to malfunctions, human error, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect, failures of any telephone or wireless network. Entry materials/data that have been tampered with or altered are void. In the event this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsor reserves the right to cancel, terminate, or suspend the Sweepstakes and, in such event, to select winners by random drawing from among all valid entries received up to such time of cancellation, termination or suspension. All entrants, as a condition of entry, agree to be bound by these official rules and by the decisions of the sweepstake administrators which shall be final and binding in all matters relating to this Sweepstakes.

10. WINNER’S LIST: Sweepstakes results and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: HES 9400 Sweepstakes Winners/Rules, 22630 N. 17th Ave., Phoenix, AZ 85027. Winner’s lists requests must be received by October 31, 2010. VT residents may exclude return postage.
